More Lottery Lawsuits

A group opposed to the lottery laid out its case today at the state Supreme Court.

The North Carolina Institute for Constitutional Law filed its brief today in its challenge to the lottery. The group says state lawmakers improperly established the lottery, Titan Barksdale reports.

In a split decision in March, the state Court of Appeals upheld a lower court’s dismissal of the group’s lawsuit that challenged the way North Carolina’s lottery was established. The lawsuit, filed in 2005, contended that the lottery is a tax and didn’t go through the procedural requirements in the legislature for new taxes.

I’ll let the legal scholars among us decide whether or not this appeal carries any weight.

While lottery opponents may have a legit legal gripe about this, there’s no doubt in my mind that many of them are waging this challenge simply because they don’t like the idea of a lottery, period. Sorry guys- I get your anger, but y’all need to chill. The lottery may be a tax on the stupid, but it is completely voluntary. No one is making these people pay their stupid tax, and quite frankly, I don’t have a problem with it. It might even shave a little bit off of my own compulsory taxes.

    It’s a shame you Americans have such a problem with your lotteries. In the UK and Europe we have well regulated/organized lottery syndicates online! One such syndicate is “Virtual World Direct”. Unfortunately the US is one of the few countries in the western world that can’t join us! It’s strange that the US leads the world in gambling (Las Vegas) and yet lotteries are such a problem.
